From 2019 to January 13, 2023 (the date of suspension of toll collection), the Ministry of Transport and the Road Administration of Vietnam coordinated with relevant agencies and units to review the project contract, through 18 negotiation sessions with BVEC, investors, and funding banks to solve problems and negotiate to adjust the time for profit-making fees.
At the time of suspension of collection, the project still had some problems that the parties could not agree on a solution such as: Preservation of equity (8.7%/year) during construction and operation. waterfall. In addition, calculating interest as loan capital in the construction period for fee revenue in the period 2009 – 2015 (375 billion dong); plan for calculating loan interest for deductions in the exploitation period; profit-making fee collection period.
“In order to avoid toll collection beyond the project’s deadline, affecting the interests of the State and the people, the Department of Roads of Vietnam reported to the Ministry of Transport and decided to suspend the project toll collection on the same day. January 13, 2023 to continue negotiating and solving problems,” said the Vietnam Road Administration.
Assessing the suspension of BVEC for traffic safety, regular maintenance and maintenance, the Vietnam Road Administration said that according to the provisions of the BOT contract, BVEC is responsible for managing and maintaining repair and maintain BOT works until the BOT works are transferred to competent state agencies to receive BOT works.
