As of August 2023, what titles will no longer be commune-level civil servants?
Effective from August 2023, Decree 33/2023/ND-CP designates commune-level cadres and civil servants and persons working part-time at the commune, village and settlement levels.
According to SK 33/2023/ND-CP, civil servants at the commune level have the following 6 titles:
Commander of the Military Command;
Office – statistics;
Cadastral – construction – urban and environmental (for neighborhoods and municipalities) or cadastral – agricultural – construction and environmental (for communes);
Financial Accounting;
Justice – civil status;
Socio-cultural.
Thus, when compared to the existing regulations, civil servants at the kelurahan level no longer have the title of Head of the Commune.
According to the Ministry of Home Affairs, the post of PNS Chief of Police was not assigned because of the regular police arrangements in the commune. Instead, the Chief of Police of the Commune will be titled the People’s Public Security Force, in line with the project to build regular communal police stations that have been implemented nationwide under Decree 42/2001/ND-CP.
What is the position of commune officials?
Also according to Decree 33/2023/ND-CP, commune level officials have the following positions:
Secretary, Deputy Secretary of the Party Committee; Chairman, Deputy Chairman of the People’s Council; Chairman, Deputy Chairman of the People’s Committee; Chairman of the Vietnam Homeland Front Committee; Secretary of the Ho Chi Minh Communist Youth Union; President of the Vietnam Women’s Association; Chairman of the Vietnam Farmers’ Association (applies to communes, sub-districts and municipalities involved in agriculture, forestry, fishing and salt production and organized by the Vietnam Farmers’ Association); President of the Vietnam Veterans Association.
Based on SK 33/2023/ND-CP, the number of cadres and civil servants is calculated according to the type of commune-level government unit, as follows:
For wards: Class I as many as 23 people; type II as many as 21 people; Type III as many as 19 people;
For communes and townships: Class I, 22 people; type II as many as 20 people; Type III numbered 18 people.
The provincial-level People’s Committees based themselves on the number of commune-level administrative units with a population size and natural area greater than the standards specified in the National Assembly Standing Committee Resolution on administrative unit standards for calculating the increase in the number of village-level civil servants as follows:
Kelurahan in a district can increase by one-third of the specified population size level to one-third of the specified population level. The remaining commune-level administrative units for each additional half of the specified population size level may increase by 1 civil servant;
In addition to the increase in civil servants according to the population mentioned above, government units at the sub-district level for every 100% increase in the determined area can add 1 civil servant.
Population size (including permanent resident population and converted temporary resident population) and area as of December 31 each year to determine the number of cadres and civil servants at the specified commune level.
If on December 31 every year there is a change in the population and natural area of a commune-level administrative unit, the provincial People’s Commission submits it to the People’s Council at the same level for consideration and adjustments to the population. cadres and civil servants at the same level, communes (including provincial administrative units) to ensure compliance with regulations.
